False Claims/Qui Tam Claims

Brewer, Pritchard & Buckley, P.C., located in Houston, Texas, assists Medicare and Medicaid providers and other health care providers throughout Texas and the United States who have been accused of fraud and who need defense against qui tam claims under the False Claims Act or Texas Medicaid Fraud Prevention Act.

The firm provides aggressive representation in cases involving claims of fraud made on behalf of the Texas or federal government. The firm also provides aggressive representation in Texas administrative, OIG and "SOHO" cases involving claims of fraud, overbilling and the like made on behalf of the Texas or federal government, the Texas Office of the Attorney General, and the Office of Inspector General of Texas Health and Human Services Commission. Providers may receive a notice from the Office of Inspector General of Texas Health and Human Services Commission. Many times, this office and other Texas state agencies try to intimidate or bully honest providers into paying massive administrative "penalties," fines or assessments. If you receive such a notice, call the lawyers at Brewer, Pritchard & Buckley, P.C.

What Is The False Claims Act?

Because federal agencies are not privy to the day-to-day activities of private companies with which it does business, it provides financial incentive to employees of those companies to report alleged fraud. A fraud claim to the appropriate law enforcement bodies on behalf of the federal government is known as a "qui tam" claim. Under the federal False Claims Act, a claimant may be entitled to treble damages, plus up to $15,000 per claim, if the reports lead to civil liability.

Boards of directors and general counsels of many leading companies have relied on the attorneys of Brewer, Pritchard & Buckley, P.C., for vigorous defense on false claims charges. Such claims may involve:

  • Medicare/Medicaid fraud
  • Double billing
  • Billing for services or goods never delivered
  • Making false claims on a contract, such as falsely claiming minority or veteran status to secure a contract

Such cases can be complex and require a great deal of investigation. But many of these cases are entirely defensible. Know your rights. The lawyers at Brewer, Pritchard & Buckley, P.C., handle complex corporate litigation throughout Texas and beyond. They produce affordable results that keep their clients financially stable and avoid being subsumed by litigation.
